Many Americans around the country were shocked on last Friday when it was leaked that House Joint Resolution, H.J.Res. 15, created by Rep. José Serrano (D- NY15) introduced the controversial joint resolution on Friday, the second day of the 2013 legislative session. What makes this simple sounding proposal shocking is the fact that he demands the repeal of the 22nd Amendment to the U.S. Constitution, which in essence would remove the limitation on the number of terms an individual may serve as President.
The last President to serve more than two terms was Franklin D. Roosevelt.
Roosevelt served three full terms as President and was elected to a fourth term and he died 83 days into his fourth term in office.
Section 1. No person shall be elected to the office of the President more than twice, and no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of the President more than once. But this article shall not apply to any person holding the office of President when this article was proposed by the Congress, and shall not prevent any person who may be holding the office of President, or acting as President, during the term within which this article becomes operative from holding the office of President or acting as President during the remainder of such term.
Section 2. This article shall be inoperative unless it shall have been ratified as an amendment to the Constitution by the legislatures of three-fourths of the several States within seven years from the date of its submission to the States by the Congress.
In Section 2 it clearly states that to make or change this Amendment it takes three fourths of the United States to approve and ratify this Amendment or change this same.
The People of this country in their states must first approve this measure then Congress shall vote on it.
The unique aspect of this the wording is vague enough to imply that Congress can remove it without the approval of the people within their states.
The reason for this Amendment which unlike many others that were attempted to be added after the 1940s is that there is a common sense philosophy and logical approach to government, and that is it prevents anyone from becoming dictator for life, or setting up an royalty within this country of a family dynasty controlling the highest post in this nation.
Many will say that FDR was one of the greatest presidents since he did get this country out of the Great Depression, yet at the same time he suspended the Constitution, for many Americans, incarceration of Japanese and penalizing people with German ancestry from working during this time frame of the beginning till the end of WWII.
FDR allowed the Japanese to bomb Pearl Harbor, and when we acquired the Enigma Machine, to allow a number of ships to be sunk to prevent the Germans from knowing we cracked their messages.
So why should we still have term limits, again what damage can one man or person do if they control the highest post in the land for life then that person can rule with absolute authority and nothing short of Hell can stop whatever they wanted to do.
What every American must do is contact their elected officials, and DEMAND on the phone, the email and if possible in person to STOP this travesty from ever happening.
I am well known but both my State and Federal Congressmen and Senators, by name, many of whom have called me a Asshole, or The Asshole, since I know and quote the Constitution, and will always keep their feet to the fire if they should ever try to stray from the Constitution.
Get your Senators and Congressmen to know you if not by name then voice, and make sure they are not trying to toss aside the very instrument they swore to protect against all enemies foreign and domestic.
